By accessing or using Fifth Coffee's website and mobile application, you agree to be bound by these Terms of Service. If you do not agree to any part of these terms, you may not use our services.
To place orders and participate in our loyalty program, you must register an account with a valid email address. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account.
All orders are subject to acceptance and availability. Payment is processed securely through Stripe at the time of checkout. Prices include applicable sales tax. We reserve the right to refuse or cancel any order at our discretion.
Members earn points on qualifying purchases and may redeem points for select menu items. Points have no cash value and are non-transferable. Birthday rewards and welcome drinks are limited to one per member and are subject to eligibility. We may modify or terminate the loyalty program at any time.
Reward items, including birthday rewards and welcome drinks, are subject to availability and may be limited. The combined value of birthday reward items is capped at a soft spending limit. Rewards expire according to the terms communicated at the time of issuance.
Creating multiple accounts, exploiting reward systems, or engaging in fraudulent activity is prohibited. Violations may result in account suspension, forfeiture of points and rewards, and permanent bans. Deleted accounts cannot be re-registered using the same email.
All content on this website and app, including logos, text, graphics, and menu items, is the property of Fifth Coffee and is protected by intellectual property laws. You may not reproduce or distribute our content without prior written permission.
Fifth Coffee is not liable for indirect, incidental, or consequential damages arising from your use of our services. Our total liability for any claim related to your use of our services is limited to the amount you paid for the relevant order.
We may update these Terms of Service from time to time. We will notify you of significant changes by posting the updated terms in the app. Continued use of our services after changes constitutes acceptance of the updated terms.
These terms are governed by the laws of the State of New York. Any disputes arising from these terms shall be resolved in the courts of New York County, New York.
